This is an appeal from a judgment for defendant in error, hereinafter referred to as plaintiff, in an action to recover damages growing out of an automobile collision at a county highway intersection.

Plaintiff was driving his automobile going east as he approached the intersection. An automobile belonging to defendant Sinclair Oil & Gas Company was being driven by defendant V. L. G'ick, an employee, north on the highway running north and south, and in approaching the intersection where the collision occurred was approaching same from plaintiff’s right.
