This case comes before us on two preliminary motions. The first is to dismiss the appeal as to the order denying the new trial on the ground that the appeal from such *425order was not taken within 60 days after the notice of the entry of the order. The judgment in this case was rendered on the 9th day of September, 1902. and subsequently a motion for a new trial was made and denied, and on the 15th day of Decern ber, notice that the order denying the new trial had been entered was served upon the respondent, and on the 17th day of February, 1903, a notice of appeal from the judgment and…
