A rather novel discovery issue has come before this Court, which has not been fully addressed in the Second Circuit and may be a matter of first impression. It was Defendant Amtrak who initially sought court intervention to decide this critical discovery imbroglio, after the parties made an unsuccessful, albeit good faith, effort to resolve it themselves.
