COLLINS, Judge.

Plaintiff, a United States deputy marshal, seeks, in this action, to recover overtime compensation alleged to be due under section 201 of the Federal Employees Pay Act of 1945, as amended. 1 The case is before us on cross-motions for summary judgment. Upon the record, which discloses no material issues oi fact, we conclude that plaintiff's motion must be denied and that defendant’s cross-motion for summary judgment must be granted.
