The plaintiff in error, Charles L. Walters, commenced his action in the probate court of Kingfisher county, against John A. Eatliff as sheriff, to recover four stacks of wheat in the field, and two hundred and seventy-five bushels of wheat in the elevator. The plaintiff alleged that he was the owner and entitled to the possession of said wheat, and that it was of the value of five hundred and fifty dollars, and that the defendant •wrongfully detained said wheat from him. He prayed judgment for the return of said wheat or its value, and one hundred dollars…
