GILES, District Judge.

Plaintiffs are options transactions customers of Hess, Grant & Company (“Hess Grant”), a stock brokerage firm. Merrill Lynch, Pierce, Fenner & Smith, Inc. (“Merrill Lynch”), also a stock brokerage firm, has a clearing agent agreement with Hess Grant pursuant to which it performs centralized cashiering, bookkeeping and execution functions for margin accounts serviced by Hess Grant for the plaintiffs.
