This was an action in assumpsit brought to recover for total and permanent disability on a group life and disability insurance policy issued by the Equitable Life Assurance Society (hereinafter referred to as the Society) , insuring employees of the Edgar Thomson Steel Works and issued to an association of such employees, and on a subsidiary certificate issued by defendant to the plaintiff under the terms and conditions of the group or master policy. A compulsory nonsuit was entered and plaintiff lias appealed from the refusal to take off the nonsuit.
