¶ 1 Marey Montgomery was a lifeguard employed by Swim Management and Consulting Services, Inc., which had contracted with Timberbrook Homeowners Association to run all facets of its common area pool. She was injured during this employment. Swim Management covered her injury through its workers’ compensation insurance. She then sued Timberbrook Homeowners Association for negligent maintenance of the lifeguard chair.
