WYNN, Judge.

This action arises out of an automobile accident on 8 May 1990. Plaintiff, Karen D. Welling, stopped at the intersection of Albemarle Road and Royal Oaks Road in Charlotte and defendant, Shelly Renee Walker, hit plaintiff in the rear. Defendant testified that she saw plaintiffs brake lights and attempted to apply her brakes, but her shoe slipped off the pedal and she collided with plaintiff.
