MEMORANDUM OPINION

WILLIAMS, District Judge.

Presently before the Court is Defendant United States of America’s (“USA”) Motion to Dismiss, or in the Alternative, for Summary Judgment. Plaintiffs, Victor A. Munger, et. al. have filed a response and Defendant replied accordingly. A hearing was held before this Court on October 6, 2000. For the reasons discussed below, the Court will grant Defendant’s Motion to Dismiss as to counts III and IV. Further, the Defendant’s motion is granted as to Victor A.
