This case has a long history. In 1995, plaintiff George E. Haskell initiated a proceeding against the defendant, the Versyss Liquidating Trust (Trust), seeking a declaration that he is entitled to full ownership of 1,266,300 shares of stock in *121Versyss, Inc. (Versyss).1 In 2000, a Superior Court judge, after a jury-waived trial, found in favor of Haskell. On appeal by the Trust, we reversed and remanded the case to the Superior Court for further proceedings. See Haskell v. Versyss Liquidating Trust, 61 Mass. App. Ct. 824 (2004).
