This case originated before a justice of the peace of Dewey county, wherein J. H. Gossom was plaintiff and Jerome J. Deninger et ux. were defendants. The parties will be referred to as first styled.

Plaintiff’s bill of particulars alleges that he is the owner and entitled to immediate possession of a certain tract of land consisting of 160 acres, the unlawful and forcible detention thereof, and service of notice to quit.
