This is an appeal from a judgment for plaintiff in an action in unlawful detainer.
The contention of plaintiff was that defendant was his tenant, and lawfully entered into possession of the premises involved. That the tenancy was from month to month, and that in November, 1929, the said tenancy was terminated by plaintiff by serving written notice on defendant to deliver up possession of the premises within five days, or pay the sum of $50. claimed to be due as rent on said premises from July 1, to December 1, 1929, and that defendant failed to pay said rental.
