This action was brought by the appellee against the appellants to recover the possession of certain real estate, situate in the town of Gosport, Indiana, and damages for waste, alleged to have been committed thereon by the appellants. The issues that were formed in the action were tried by the court, and resulted, over a motion for a new trial, in the rendition of a judgment in favor of the appellee, for the possession of the property, and for damages.
