April 10, 1933:

Plaintiffs, by their uncle as next friend, brought this action to recover damages for the death of their father in a collision between the automobile in which he was riding as a guest and a freight train of defendant. There was a verdict for plaintiffs in the sum of f30,455. From the judgment entered on the verdict defendant appealed, assigning as error the refusal of its motions for judgment n. o. v. and a new trial.

The collision took place between 4: 30 and 5 o’clock on Christmas morning, 1930, at the Nineteenth Street crossing of defendant’s tracks…
