Plaintiff brought this action against Samuel Messer and the Quaker State Oil Refining Company, a corporation of which he is president, for injuries alleged to have been caused by the negligence of their servant, Forrest O. Koontz, who is plaintiff’s husband. These defendants thereupon caused a writ of scire facias to issue to bring Koontz upon the record as an additional defendant, alleging him to be liable over to them for the cause of action declared on.
