Respondent-appellant Charles Greiner, superintendent of the Sing Sing Correctional Facility (“appellant”), appeals from a judgment of the United States District Court for the Eastern District of New York (Weinstein, J.) entered on December 19, 2003, granting a writ of habeas corpus to petitioner-appellee James Benn (“Benn”). See Benn v. Greiner, 294 F.Supp.2d 354 (E.D.N.Y.2003).
