Petitioner, John Howard, appeals from a judgment of the United States District Court for the Western District of New York (Feldman, M.J.) denying his application for a writ of habeas corpus under 28 U.S.C. § 2254. Howard was convicted of various charges, including Murder in the Second Degree and Burglary in the First Degree, on August 26, 1994 in the County Court of the State of New York, Monroe County.
