Appeal from an order of the Supreme Court (Rumsey, J.), entered November 6, 1998 in Tompkins County, which, inter alia, denied defendant’s motion to dismiss certain of plaintiffs claims and granted plaintiffs cross motion to compel discovery responses.
On January 19, 1997, a fire destroyed plaintiffs home and its contents.
