This is an action for personal injuries sustained in an automobile and bus collision at a point about 25 miles southeast of Eugene, Oregon, on the Willamette Highway.

The accident occurred between 7:30 and 8 a. m. on December 12, 1943. There was ice on the pavement.

Plaintiff, It. E. Cavett, was riding in the front seat of a Pontiac Two-door Torpedo Sedan owned and being driven by Andrew J. Tacchella. Louis J. Tacchella, the driver’s brother, was in the back seat.

The Tacchellas' and Cavett, the plaintiff, who were officers of the Ideal Dairy Company, had left Portland at four o’clock that…
