This case comes to us by a Certified Question from the United States District Court, District of Maryland, pursuant to the Maryland Uniform Certification of Questions of Law Act, Maryland Code, §§ 12-601 through 12-613 of the Courts *320and Judicial Proceedings Article (1974, 2002 RepLVoL), and Maryland Rule 8-305. The question of Maryland law set forth in the Certification Order is as follows:
