Appellant was indicted, tried, and convicted by a jury in the court below of murder in the second degree. Sec. 2415, Burns 1926, §10-3405, Burns 1933, §2407, Baldwin’s 1934, Acts 1905, p. 584, §350. Judgment and sentence to imprisonment for life. His motion for a new trial was overruled and this ruling is the only error assigned.
