On January 22, 1924, the defendant insured the life of plaintiff in the sum of $5,000. Attached to the policy was a supplementary contract providing for the payment of $50 per month in ease of the total and permanent disability of the insured, payable, however, for not more than six months prior to the date of required proof of disability.

Plaintiff, a student at the University of Michigan, left on December 15, 1925, and went to North Carolina for his health. He was then ill. While there, he talked with a man whom he met, who had a similar policy, and wrote his father about it. The father took…
