CALABRIA, Judge.

Custodio Olea Ramirez (“defendant”) was indicted by the Wake County Grand Jury on 17 September 2001 and was charged with two counts of assault with a deadly weapon with intent to kill inflicting serious injury and one count of attempted murder. The case was tried before a jury at the 3 December 2001 session of Wake County Superior Court, Judge Abraham Penn Jones (“Judge Jones”) presiding.

The evidence tended to show that between midnight and 1 a.m. on 29 July 2001 defendant slowly drove through the parking lot of the Top Rank Sports Bar (“the bar”) on Poole Road in Raleigh.…
