This was a civil action for the recovery of a truck and for judgment on note, in which defendant T. T. Edwards set up a defense of infancy at time contract was made and a counterclaim against plaintiff and his codefendant, Mid-South Motors, Inc. From an adverse verdict and judgment, T. T. Edwards appealed to the Supreme Court.
The jury having been selected, sworn and impaneled, the pleadings were read, the witnesses duly sworn and the following evidence offered and agreements made by and between the counsel:
