The municipality of Oklahoma City entered into a contract with: Chas. T. Derr, in the year 1906, for the construction of a sewer system. It is claimed by the contractor that the city failed to pay him in accordance with his contracts. The plaintiff in due time commenced his action for the recovery of the indebtedness. The trial of the cause resulted' in judgment in favor of the plaintiff.
