On the 8th day of Novomber, 1921, plaintiff in error filed in the district court, in and for Oklahoma count}', 'his petition seek'ing a peremptory writ of mandamus requiring the defendant in error, as State Auditor, to approve and issue a warrant to the plaintiff for the sum 'of $225 for salary from May 1 to May 31, 1921. The defendant filed an answer, alleging that the x>laintif£ performed no services for the state of Oklahoma and was not entitled to any compensation.
