G. W. Smith, plaintiff, commenced this action against D. B. Maher, defendant, in the district court of Osage county to recover $660 damages. The petition of the plaintiff in substance alleged that on or about the 10th day of July, 1917, plaintiff delivered to the defendant 30 head of cattle pursuant to the terms of an oral contract entered into between the plaintiff and the defendant, under the terms of which the defendant accepted the cattle for. the purpose of pasturing them until such time as the defendant notified the plaiptiff that the cattle were ready for market.
