MONROE, J.

Plaintiff alleges that he obtained judgment against the defendant Joseph Dugué for $895.75, recorded his judgment, and issued a writ of fi. fa. which was returned nulla bona; that after the institution of the suit, and before judgment, the defendant transferred the only property that he had out of which petitioner could have obtained payment, to wit, certain improved lots in New Orleans, to Miss Ruth Johnston, the consideration of the transfer purporting to be the note of the purchaser for $3,000, payable three years after date;…
