An information was filed in the superior court of Spokane county, charging John H. Messner, J. W. Prall and Anette Franzen with the crime of conspiracy, committed as follows:
“That the said defendants, John H. Messner, J. W. Prall and Anette Franzen, on the 22nd day of July, A. D. 1905, in the eounty of Spokane, aforesaid, maliciously and un*209justly devising, to cheat and defraud one Mary A.
