This is an action brought by Artesian Water Company (“Artesian”) against New Castle County (“County”) pursuant to Section 107 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (“CERCLA”), 42 U.S.C. § 9607, to recover costs incurred in providing alternative sources of drinking water for its customers.
