Appellants are the surviving husband and children of Ruth Miriam Zitomer who died on November 6, 1969 as a result of the alleged malpractice of her doctor and of the hospital where she was treated for injuries sustained in an automobile accident.

On the date of her demise, a two-year period of limitations was applicable to actions for wrongful death under the then existing provisions of Code, Art. 67, § 4. Accordingly, the action would then have been barred as of November 6,1971. A two-count declaration for wrongful death was…
