This matter comes before the Court on defendant UNICCO Service Company’s (“UNICCO”) “Motion to Dismiss Counts Two, Three and Five of Complaint” [4], defendants Argueta and Fernandes’s “Motion to Dismiss Complaint” [12], and defendant Alarcon’s “Motion to Dismiss Complaint” [16].
