Tbe defendant was charged by information with opening up, conducting and operating as dealer a gambling game, to which be pleaded not guilty. Upon the trial, the jury returned a verdict of guilty. The defendant moved for a new trial, which motion was overruled, and, from the judgment and sentence entered upon the verdict, appeals.
