For approximately seven years prior to December, 1939, Julius C. Herbsman had been in the employ of the port of Seattle, a municipal corporation. December 16, 1939, at about six-thirty o’clock in the evening, Mr. Herbsman was driving his automobile in a northerly direction along the east side of Eastlake avenue, an arterial highway, in the city of Seattle.
