This case is before the court upon the following agreed statement of facts:

“That on April 26, 1909, the Flint Wagon Works sued out a writ of replevin in this court against William E. Maloney, at that time sheriff of Kent County. That said writ was executed by William A. Willis, at that time coroner of said county. That under said writ the goods and chattels named in the list hereto attached and marked ‘Exhibit A’ were taken from the defendant.
