I. Introduction

Appellants D.R. Horton — Texas, Ltd.' (D.R.Horton) and DRHI, Inc. (DRHI) appeal a summary judgment in favor of Ap-pellee Savannah Properties Associates, L.P. (Savannah). In three sub-issues, D.R.
