This is an action to recover damages for an alleged trespass committed by the defendant upon the plaintiff’s real property in Yamhill County. The complaint charges a wrongful and forcible entry in the months of April and November, 1886, and the breaking down and destruction of the plaintiff’s fence, to their damage in the sum of $1,880. The answer put in issue all of the material allegations of the complaint, and then, as a further and separate defense, alleges that a certain county road existed on the plaintiff’s said land at the place of said alleged entry, and that the fence mentioned was…
