It appears from the record in this case that on the 22nd day of September, 1903, the appellee instituted in the Court of Common Pleas of Baltimore City an action of assumpsit against the appellants. The declaration setting forth the plaintiff’s cause of action was filed at the institution of the suit and was accompanied with a statement of the particulars of the indebtedness of the defendants to the plaintiff according to the plaintiff’s claim; as also with the affidavit of the plaintiff that there was justly due and owing by the defendants to the plaintiff “as per said declaration and on the…
