OPINION
BRUGGINK, Judge.
This case concerns an alleged breach of contract or Fifth Amendment taking by the Government in the aftermath of the Space Shuttle Challenger disaster. This suit, along with a similar one addressed in the companion case of American Satellite Co. v. United States, 26 Cl.Ct. 146 (1992), also issued today, raises a number of difficult and unique issues. The plaintiff contends that the President’s decision to remove the National Aeronautics and Space Administration (“NASA”) from the business of launching commercial satellites damaged plaintiff in the amount of $288,454,000.…
