This is a proceeding brought originally in this court on July 2, 1956, by Woodrow Shelton, petitioner, against the Sheriff of Allen County, Ohio, seeking a writ of habeas corpus for the discharge of petitioner from the custody of the sheriff.

In his petition filed herein, the petitioner, among other things, alleges that he was “imprisoned and restrained of his liberty by Clay T. Cotterman as Sheriff of Allen County, Ohio, in the jail of said county without any legal authority, but under color of a pretended state warrant which is hereto attached, made a part hereof, and marked ‘Exhibit A.’ ”…
