This case is before the court on defendant’s motion for summary judgment1 and plaintiffs’ cross-motion for partial summary judgment. Plaintiffs come to court after having obtained an appellate judicial ruling that their property never constituted jurisdictional wetlands for the nine-year period that most of it was subject to a Cease and Desist Order, which is not surprising in that the Government’s own reclamation project drained the lands in question prior to plaintiffs’ purchase.
