THIS CAUSE comes before the Court on the parties’ various motions for sum mary judgment. 1 This Court heard argument on October 22, 2004, and additional argument was heard on September 30, 2005. The following briefly summarizes the most salient facts of this case, all of which will be addressed in greater detail below.
