DECISION REGARDING THE DEFENDANTS’ JOINT MOTION FOR SUMMARY JUDGMENT AND THE PLAINTIFF’S CROSS-MOTIONS FOR SUMMARY JUDGMENT

Before the court are cross-motions for summary judgment filed by the various parties to this proceeding. The plaintiff, Wendell W. Webster, is the trustee in the case under chapter 7 of the Bankruptcy Code, 11 U.S.C. § 101 et seq., of NETtel Corporation, Inc. (“NETtel”). Pursuant to 11 U.S.C. §§ 547 and 550, he seeks to avoid and recover transfers allegedly made by NETtel to the defendants The Management Network Group, Inc. (“TMNG”)…
