Venton Miller, the twenty-one year old, unmarried son of plaintiff, was run over and killed by a west bound passenger train of the defendant railroad on the morning of February 7, 1934, at about the hour of 2:30 o’clock a. m. The deceased was struck and run over while lying on the railroad track in a drunken stupor, having lain down on the track on his way home after attending a dance, and after having lost his way in returning home, evidently because of his drunken Condition.
