Melvin Harvey Williams, a young negro man, was struck and run over by a switch engine of the Missouri Pacific Railroad Company about 3 o'clock of the morning of August 6, 1940, causing injuries from which he died three and one-half hours later.

In this action, damages resulting from the accident, injuries and alleged wrongful death are claimed by decedent's parents, Jennie Brooks and Luther Williams. Those made defendants are Frank Jones, the engineer operating the locomotive, and Guy A. Thompson, trustee for the Missouri Pacific Railroad Company.
