This application grows out of a suit for damages on account of the death of plaintiff’s husband, who was run over and killed by one of defendant’s trains on March 15, 1925, in the outskirts of the town of Ruston, La. The plaintiff sued for $10,000 in her own right, and, as tutrix to her two minor children, for $10,000, in the proportion of $4,-500 for the oldest and $5,500 for the youngest child, with interest on said sums from judicial demand and for costs.
