This is an action for a writ of prohibition. The facts, briefly stated, in so far as material herein, are as follows:

On May 14, 1929, a petition was filed in the District Court of Converse County by Merrieo Royalties Company, a Wyoming corporation, as plaintiff, against the Merritt Oil Corporation, a Maine corporation, as defendant.
