MEMORANDUM AND ORDER
JULIE A. ROBINSON, District Judge.
Plaintiff Trence Robinson alleges that his employer, The City of Arkansas City, Kansas (“the City”), promoted him to a supervisory position in September 2007. He alleges that, despite assuming clearly supervisory duties and responsibilities, and despite being told that he would be classified and paid as a “Sanitation Foreman,” the City declined to classify and pay him in accordance with the new position.
