Appellants Roger and Jennifer Sefzik appeal a summary judgment entered in favor of appellees Mady Development, L.P. and MDC-Trinity Heights, L.P. In five issues, appellants claim appellees were responsible for the additional taxes on the property; the trial court erred in failing to award appellants attorney’s fees; appellants are entitled to a trial on their affirmative defense; and appellees are not entitled to recover on their subrogation claim.
